The following purchase terms apply from 2020-11-26

The terms of purchase, together with your order, which is confirmed by an order confirmation, constitute the contractual basis for the purchase.

To be able to shop at Elcare’s online store, you must be 18 years of age or older.

These terms and conditions apply when you as a consumer make a purchase at Elcare’s online store. If you purchase through a company, any other agreed terms and conditions or the Swedish Sales Act (1990:931) apply instead.

Where these terms and conditions require written documentation, this will be fulfilled by email, text message, letter or similar.

“Seller” is referred to below as, “Elcare” “we”, “us” or “the seller”. Buyer is: the person specified as the buyer in the order, and is referred to below as “you”, “your” or “yours”.

2. Your order

When we receive your order, we will confirm the order and automatically send you an order confirmation to the email address you have provided. Please read the order confirmation carefully when you receive it, and check that the order confirmation matches the order.

Any discrepancies between your order and the order confirmation are considered a new offer from us, which you can accept or decline. If you have ordered more than one product, you may receive the products in separate shipments.

We reserve the right to cancel your order or part of it if the product is out of stock. If a product is out of stock, you will be notified, possibly together with information about what we can offer instead. You will be given the option to accept our new offer with the changes we specify compared to your order, or to cancel the order entirely. We also reserve the right to cancel orders intended for resale.

If a significant typographical or printing error has occurred on the part of the seller, in advertisements and the like and/or in the online store, which is greater than 15% of the normal sales price, the seller may unilaterally change, delete or reject the order. This also applies if the customer has received an order confirmation or the like. We also reserve the right to cancel your order, as well as not to maintain our customer guarantees as a result of force majeure. This applies if it is not possible to fulfill the terms of the agreement. This may be due to extraordinary circumstances and events that Elcare could not have foreseen, such as war, extraordinary natural events, fire, strike and pandemics.

We have the option to make changes until the item is shipped from our warehouse. If the item has been shipped from our warehouse, you must exercise your right of withdrawal.

3. Payment

When you shop at Elcare’s online store, payment is handled by Electrocare Nordic AB. If you have any questions about payment, you can contact Elcare’s customer service at delesalg@elcare.com

All prices include VAT. The order overview includes all costs associated with the item, such as postage, shipping, packaging, etc.

When making a payment, you can choose from the payment methods we offer in the purchase process. To minimize the risk of unauthorized access, your card details are encrypted. Once we have received your order, we will place a reservation on your payment method to ensure that there are sufficient funds to cover the purchase amount and complete the transaction. If no reservation can be made, we reserve the right to cancel the order. You will then be informed of any cancellation.

When making a payment, you will be charged when we confirm your order and delivery has begun with us. This also applies to pre-orders of products that will be available in the future or that have an unconfirmed delivery date.

5. Delivery and delay

The products will be delivered in the manner specified on the order confirmation. We bear the risk of the products until they are taken over by you, i.e. when you have received the products into your possession.

If the delivery of the products is delayed, we will provide you with information as soon as we have knowledge of it, as well as information about, and possibly when, delivery can take place, or if the product(s) is/are out of stock.

If you have ordered more than one product, you may receive the products in separate shipments.

5. Complaints

After you have received the products, we recommend that you investigate as soon as possible whether the delivery corresponds to the order confirmation, whether the products have been damaged during transport or whether the products otherwise have errors or deficiencies.

If the products are faulty or have defects, you can, depending on the circumstances, demand that the defect be rectified, demand a new delivery, a price reduction, compensation or that the purchase be cancelled. The buyer can demand redelivery or have the goods repaired if this can be done without unreasonable cost to the seller. Notification of defects and defects in the products can be made to us verbally or in writing. This must be done within a reasonable time after you have discovered or should have discovered the defect or defect. However, you always have at least two months to make a complaint. For evidentiary reasons, we recommend that you send the complaint to us in writing. The right to make a complaint is valid for three years after you received the product, unless otherwise provided by a guarantee or similar undertaking. The complaint must be directed to the seller, i.e. Elcare. When purchasing through a company, the buyer has a 2-year right of complaint according to the Sales Act.

6. Right of withdrawal

The Swedish law on distance and off-premises contracts gives you the right to cancel your purchase. The right of cancellation applies to goods and individual services. The right of cancellation requires that you notify the seller that you wish to exercise the right of cancellation no later than 14 days after you have received the delivery, primarily by using the cancellation form you have received via email with the order number as a reference.

In order to exercise the right of withdrawal, the product must be returned to us in approximately the same quantity and condition as when you received it. The seller is entitled to compensation for, among other things, any decrease in value due to the buyer handling the product to a greater extent than necessary. All products must be returned to the seller within a reasonable time, no later than 14 days from your notification of the exercise of the right of withdrawal. You are responsible for any shipping costs for the return.

The seller is obliged to refund the full purchase price, including postage for the shipment, handling fee, customs fees, cash on delivery, etc. Refund must be made no later than 14 days from the day the seller has received the product together with the return form .

The product should be sent back to us by company parcel (not REK.), if possible in the original packaging, together with the Swedish Consumer Agency’s standard form (withdrawal form) which you can find here . The buyer is responsible for the postage.

The buyer cannot cancel the purchase of goods that rapidly decrease in value, goods that cannot be returned, or audio or video recordings (including CDs and DVDs) or computer programs on which the seal has been broken.

7. Personal data

8. Disputes

The parties shall try to resolve any disputes amicably. As a consumer, however, you can always refer any dispute to the Swedish National Board of Consumer Complaints (ARN). You can contact ARN either via their website www.arn.se

The parties to the case are the seller, i.e. Electrocare Nordic AB. All disputes shall be resolved according to Swedish law. If the case is brought before a court, it shall be decided in your (the buyer’s) court of law, i.e. normally near your place of residence.
